General conditions of sale

The consumer has the right to inform the company of his decision to cancel the purchase, without payment of any compensation and without having to justify this decision, within 14 days from the day after delivery of the item or conclusion of the service contract.

Introduction :

These general conditions govern, on the one hand, the use of the sales site of SPRL Les Chaussures d'Eva de Chièvres, which may also act under another commercial name (hereinafter referred to as ' the Seller '), whose registered office is located at 7950 Chièvres, Rue Emile Dooms 20, registered under company number 0643.563.920, and the site www.chaussuresraoul.be [2] (hereinafter referred to as “ the Site ”), e-mail contact@chaussuresraoul.be[3]. These general conditions also apply to the online sale of certain products (hereinafter referred to as 'the Products'), via the Site, by the Seller, in Belgium.

The Site was created and is managed by the Seller. Users of the Site (hereinafter referred to as 'Users') are authorized to view the information on the Site on screen and to print it for their personal use.

Each user wishing to make a purchase confirms that they are a natural person, not a trader, and not having been declared legally incapable. Any person who has been declared legally incapable pursuant to Article 1123 et seq. of the Civil Code may not, under any circumstances, make purchases on the Site. Consultation of the Site and the services offered therein are the responsibility of the legal representative. This legal representative is required to comply with these provisions.

With regard to obtaining personal data, the legal representative is required to complete the registration form himself or to give the person declared incapable his express authorization to complete this form, it being understood that the provisions relating to personal data appearing in Article 11 below remain fully applicable.

The parties agree to consider this contract as the sole legal relationship governing their relations, to the exclusion of any condition previously described on the Site. In the absence of a rule, the customs of the 'distance selling' sector apply, as used by companies with their headquarters in Belgium.

I. Purpose:

These general conditions govern, on the one hand, the simple use of the Site by their Users. On the other hand, they also apply to online sales by the Seller on Belgian territory. These conditions also aim to define the terms of sale, in particular with regard to ordering, service, payment and delivery; they determine the terms to be respected when placing an order; and they guarantee the follow-up of this order between the contracting parties.

II. Order:

Any User has the option to click online on the Product of their choice. The online order can only be processed when the User has clearly identified themselves. Any order implies acceptance of these general terms and conditions of sale, the prices and the description of the Product offered for sale.

The Seller undertakes to process orders placed via the Site until stocks are exhausted. Within two days of the Seller receiving the User's order, the Seller will send the User an order confirmation email to the email address provided, indicating the number assigned to this order.

When ordering, the User must indicate the payment method of their choice (payment at the delivery/collection point, payment by bank/credit card, payment by transfer), as well as the desired location for delivery/collection.

III. Delivery:

The Products are delivered by courier service (Bpost) to the delivery address indicated by the User. This courier presents the order at the delivery address (3 to 6 working days. During peak periods, delivery may take up to 4 weeks.). If no one answers, the driver will leave a notice in the mailbox at this address indicating that the package can be collected from the nearest post office.

The User acknowledges that he is aware that the Seller's general delivery conditions apply to the shipment of the Products, and acknowledges that he accepts them.

The Seller undertakes to deliver the Products as quickly as possible. The Seller and the User agree on an indicative delivery time of 30 days. However, the parties accept that the delivery time may be longer than this indicative delivery time due to exceptional circumstances.

A valid ID must be presented upon delivery/collection of the purchased Products. The Products may only be collected by the person who placed the order. The Seller reserves the right to refuse delivery/collection if the person who presents themselves for the collection of the Products is unable to present a valid ID. The order will remain at the User's disposal for 5 days at the delivery/collection point chosen by them, after which the Products will be returned to the Seller.

Subject to changes resulting from circumstances beyond the Seller's control (such as an increase in Bpost rates or personnel costs), the delivery costs of the Products are as follows:

• Delivery to Belgium, France, Luxembourg and Switzerland: free

IV. Gift certificates:

The user has the option to purchase one or more gift certificates worth €20 online. These gift certificates can be used to purchase Products on the Supergoodies.com website.

The user has the choice between an electronic gift certificate or a classic (paper) gift certificate:

The eGift Certificate is emailed to the User after purchase. This certificate can then be printed or forwarded to a person of their choice. Each eGift Certificate contains a unique code and can only be used once.

The classic (paper) gift certificate is sent to the User, after online purchase, by registered mail. Delivery of gift certificates is free.

V. Reference:

In accordance with the law of April 6, 2010 on commercial practices and consumer protection, the User has the right to revoke his online order within 14 days from the day after delivery of the product.

The purchased Product must be returned to the Seller's return address below. The Product must be intact and in its original condition, and sent in its original packaging with sufficient postage. The user must include their bank account number with this shipment, to enable the Seller to make the refund. Only the amount actually paid will be refunded, and this within 30 days of receipt of the Product at the return address.

Return address:

Raoul Shoes
Grand'Place 5
7950 Chièvres (Belgium)

These conditions for order cancellation and the return address only apply to Products purchased via the webshop.

The cost of returning Products ordered online is the responsibility of the User, except in the case where the delivered Product did not meet the description of the Product as mentioned in the order (for example when the Product is damaged). Damaged Products must be returned to the return address within 14 days of receipt, in a sufficiently stamped envelope/parcel and accompanied by a description of the damage. The refund period for damaged items returned to the return address is 30 days.

VI. Guarantee:

All Products are covered by a 2-year warranty from the date of delivery. The parties agree that the nature of the Products does not justify the legal presumption that any lack of conformity that appears within 6 months of delivery is presumed to exist at the time of delivery (within the meaning of Article 1649 quater, §4 CC). Defects attributable to an accident, negligence or incorrect use (by the User or a third party) are not covered by the warranty and are therefore not considered to be lack of conformity. The warranty must be invoked by depositing the Products (dry, clean and in a state of good hygiene) at a Mephisto point of sale or by shipping the Products, accompanied by proof of purchase, to the following return address:

Raoul Shoes
Grand'Place 5
7950 Chièvres (Belgium)

The user is required to clearly indicate where the item has the claimed defect. The Seller's warranty department will then contact the supplier of the Product, who will decide whether or not to cover the claimed defect under the warranty. If the claimed defect is not covered by the warranty, the Product will be returned to the user without repair.

Shoes must always be returned in pairs, along with all accessories. Due to their nature, shoes must be visibly well-maintained to be eligible for warranty coverage. Shoe soles are never covered by warranty, except in cases of obvious manufacturing defects.

However, failure to comply with the delivery deadline may never be invoked to obtain any compensation, nor the termination or invalidation of the purchase agreement.

VII. Payment:

Unless otherwise agreed between the Parties, all amounts due are payable on site, at the delivery/collection point chosen by the User, at the latest at the time of delivery/collection. When registering their order, the User has the choice between the following payment methods:

Credit Card: Pay for your products in a snap with your credit card. If you choose this method, you are required to provide your Visa, Mastercard, Maestro, or Bancontact card number, as well as the verification code and expiration date. After that, the amount due will be immediately deducted from your account. You will receive a confirmation immediately after payment.

Paypal: Pay for your products in a snap with Paypal. Select either one and log in to your Paypal account. The amount due will then be immediately deducted from your account. You will receive a confirmation immediately after payment.

Bank Transfer Pay for your purchases in the blink of an eye by bank transfer: Select this payment method. In addition to the confirmation, you will receive an email containing the payment information for the transfer. In the event of non-payment, a first reminder email will be sent to you after two days. If payment has still not been made four days later, the order will be canceled.

When the order is made available to the User at the delivery/collection point chosen by the User, a second email is sent by the Seller to the User, at the email address previously indicated. The User can proceed to payment for his order when collecting the Products, at the delivery/collection point.

VIII. Acceptance and Recourse:

Any problem or defect relating to the delivery/collection of the Products (such as damaged Products or non-conformity of the Products with the order) must be reported by the User to the Seller within 7 days of receipt of the Products, by acknowledgment of receipt. In the event of notification of a problem/defect, the User undertakes to return the Products received to the Seller within 7 days of their delivery/collection. The costs related to this return shipment are borne by the Seller.

No recourse may be accepted if it appears that the Products have been used improperly, that the Seller's instructions and guidelines have not been followed, or that it is contradictorily established that the defects are not attributable to a failure by the Seller.

IX. Price:

All prices include VAT, in accordance with the rate in effect on the date the User registers the order. However, the Seller reserves the right to adjust the prices mentioned on the Site when circumstances beyond its control result in an increase in the cost price of the Products, such as an increase in supplier costs, an increase in salaries, social security contributions, transport costs, etc.

X. Signature and Proof:

Any User who does not yet have a customer number must comply with the registration procedure as defined on the Site, at the end of which a customer number will be assigned to them. The final confirmation of the order by the User constitutes acceptance of the order at the price indicated. This acceptance by the User serves as a signature and express approval of all transactions carried out via the Site.

XI. Responsibility:

The purpose of this Site is to allow the User to consult general information relating to the activities of the Seller.

With regard to access to the Site, the ordering process, delivery and other services, the Seller is only bound by an obligation of means.

The Seller makes every effort to ensure that the Site is accessible at all times to a normal number of Users. However, the Seller reserves the right to suspend access to the Site in whole or in part, for maintenance, updating or other reasons, even without prior notification.

The Seller cannot be held liable for any inconvenience or damage incurred due to the use of the Internet, in particular due to a system failure, an act of intrusion or computer hacking, contamination by a virus, information posted or processed by third parties on the Site, or any other fact or circumstance considered by case law to be a case of force majeure. The Seller does not bear any liability whatsoever for indirect damages, such as loss of income, customers, etc.

The Seller cannot be held responsible for failure to meet the delivery deadline when this delay is attributable to a carrier, the loss of items or a strike. The User declares to be informed of the risks inherent in transport and undertakes to address all requests on this subject to the carrier.

In any event, and even in the event of serious fault or breach, the Seller's liability is limited to 50% of the value of the Products ordered.

XII. Protection of privacy:

The Seller reserves the right to collect, exclusively for its internal use, data concerning the User, both directly by recording the information communicated by the User when ordering, and indirectly, for example via cookies (small strings of data stored in the User's computer, which allow the Seller to personalize the presentation and content of the Site according to each User).

This data may be communicated to organizations contractually linked to the Seller (such as business partners, associations, charities or interest groups), who wish to send the Customer personalized offers or keep them informed of their promotions.

In accordance with the law of December 8, 1992 on the protection of privacy, the User has the right at any time to consult his personal data, to modify it or to have it deleted if he no longer wishes to receive information relating to our activities. To do this, he simply needs to send a letter to this effect to the Seller's Customer Service.

XIII. Intellectual property:

All elements of the Seller's Site, namely both visual and audio elements, including the technologies used for this purpose, are covered by copyright, trademarks or patents, or more generally by intellectual property law. These elements are the exclusive property of the Seller.

Without prejudice to the law of June 30, 1994 relating to copyright and related rights, the reproduction, dissemination, sale, distribution, publication, modification, translation, transformation and use for commercial purposes of all or part of this Site are prohibited, except with the prior written authorization of the Seller.

Users who have their own website and who wish, even exclusively for their own personal convenience, to insert an automatic link to the Seller's Site, are required to obtain the express prior authorization of the Seller.

However, any hyperlink to the Seller's Site using framing or inline linking is expressly prohibited. In any event, any link must be removed upon simple request from the Seller.
XIV. General:

The invalidation of any of the provisions of these general conditions does not in any way affect the validity of the other provisions of these general conditions and does not in any way entail their cancellation.

The User acknowledges having read these general conditions online and acknowledges accepting all of their provisions, conditions and prices.

The User undertakes to inform the Seller without delay, by registered letter, of any change of address.

These general terms and conditions and the legal consequences arising therefrom are governed exclusively by Belgian law. All disputes arising from these general terms and conditions shall fall under the exclusive jurisdiction of the courts and tribunals of the judicial district of Leuven, regardless of the terms of payment or delivery. The parties agree to choose Leuven as the place where the obligations arising from the delivery of the Products by the Seller to the User are incurred, within the meaning of Article 624, 2° of the Judicial Code.
